The word Repugnant means arousing disgust or aversion; offensive or repulsive, contradictory; or inconsistent (American Heritage Dictionary – Repugnant). Repugnant Laws Contrary to; in conflict with.
The legal condition repugnant declared unconstitutional a law passed by Congress and signed by the President (Legal Definition). The word repugnant and the legal definition have the same meaning according to the constitution Marbury v. Madison. The goal is to make sure that everyone can understand the word repugnant.
Repugnant laws are being created all the time. In order for them to become null and void a judicial review needs to occur. (Click >>>Take a Look at Some Recent Supreme Court Cases)
Judicial Review: the power of the courts of a country to examine the actions of the legislative, executive, and administrative arms of the government and to determine whether such actions are consistent with the constitution. Actions judged inconsistent are declared unconstitutional and, therefore, null and void. The institution of judicial review in this sense depends upon the existence of a written constitution. (Britannica – Judicial Review)
Judicial review by the US Supreme Court of the constitutional validity of a legislative act requires:
1) Comprehensive inventory of relevant cases
2) Catalog of cases in which the Court has struck down a federal statute
3) Complete catalog of cases upholding laws of Congress against constitutional challenge
4) Offer a reassessment of the prevalence of judicial review
5) An account of how the power of judicial review has evolved over time
6) A persuasive challenge to the idea of an anti-democratic, and heroic Court
The Court, Repugnant Laws suggests, is a political institution, operating in a political environment to advance controversial principles, often with the aid of political leaders who sometimes encourage and generally tolerate the judicial nullification of federal laws because it serves their interests to do so (Keith Whittington on Repugnant Laws).
