House Bill 3653 also called Safe-T Act was passed on January 13, 2021. Below is a list of what it means for Chicagoans:
1) Use of Force Standards
Prisoner Representation Reform, p. 1: • Collect data on the addresses of prisoners’ within the last 10 years and will be used for redistricting purposes. Effective date: January 1, 2025
Deaths in Custody, p. 6: • When a person dies while in custody of a law enforcement agency, a local or State correctional facility, or a peace officer they will report, publish trends, and summarize deaths in custody. • Effective date: July 1, 2021.
Task Force on Constitutional Rights, p. 12: • Creates a task force to develop and propose policies and procedures to change constitutional rights and remedies, including qualified immunity issues for law enforcement. The Task Force ends on January 1, 2022.
2) Bail Reform, pp. 15, 64, 96, 116, 245, 275, 279, 307, 331, 357, 414, 539, 547, 576:
Eliminates cash bail which can be used during pre-trail for fines and tickets. Some statutory changes will replace bail with pretrial release or conditions of pretrial release.
Removes all the fees for processing bail.
New standards for setting bonds is that they no longer care about your previous failure to appear court appearances. They used to set bond standards on the previous record of a court appearance to determine if you were at high risk for a bond, and they would set the bond high. They no longer care about that. The only consideration for a pre-trial release is if you miss court on a current case, not a previous case for the case that you are currently released on.
3) Eligibility release based on certain offenses (forcible felonies, stalking offenses, a victim of abuse was a family or household member, domestic battery, sex offenses, and other offenses with a real and present risk to a specifically identified person or persons) Requires a judge to create a less restrictive condition, these people will not have a previous conviction of any of the above offenses. It will be decided by the judge and the judge must consider the person’s previous criminal record for an offense to be eligible for release.
What this means is that a person that does not have a criminal record or is in jail with a criminal record for any of the above-mentioned offenses for the 1st time might be considered for release. Therefore, New offenders arrested are released under certain circumstances. Unfortunately, ex-offenders, who re-commit offenses are required to be in jail until their case is over (adjudicated). Regardless of the offense, if you have a conviction on your record you will be sitting in jail until your case is over.
Next, sex offenders will not be getting out of jail. This bail system protects people that do not have a previous criminal record, not ex-offenders. All releases must have a validated risk assessment tool (Video) completed before any person is released from jail. The risk assessment analyzes case characteristics such as charge information and criminal history, failure to appear, and new arrest. Therefore, if you go and commit a crime you will stay in jail for however long the case takes to get over if you have a criminal record. Having a criminal record, individuals will be staying in jail without a bond.
Please note: The risk assessment cannot be the only form used to deny a person’s release. There are also other factors.
Revoking release when the person is charged with a detainable offense, another felony or Class A misdemeanor, or a violation of an order of protection. The court must consider facts after a hearing where a person has defense counsel to determine revocation. • Effective date: January 1, 2023. Here is the Definition of Detainable Offense:

What this means is that if you have a previous record you will be detained and stay detained because your record will reflect that you need to be detained. They will not consider release in any form. The court will not consider new, old, or current information to keep you from being detained.
4) Mandatory Supervised Release, p. 526: Decreases the supervision length for most offenses, except for first-degree murder, some sex offenses, domestic violence offenses, and crimes subject to the Truth in Sentencing (TIS) requirements.

(4) 330 people with sex offenses remain in the category receiving 3-year to natural life MSR terms.
(6) 570 people with domestic battery offenses remain on 4-year MSR terms.
(7) 600 people subject to 85% TIS restrictions remain on the current MSR terms: – 420 people with Class X: 3 years – 150 people with
Class 1 or 2: 2 years – 25 people with Class 3 or 4: 1 years
Some offenses would fall under multiple paragraphs, particularly between Paragraphs (1), (4), (6) and (7).
The numbers presented above are based on the first release from prison and do not include people leaving after a technical violation readmission. • Effective date: July 1, 2021.
5) Expand Probation Eligibility, p. 543: • Expands eligibility for Veterans Court Treatment and Mental Health Court Treatment Act to include nonprobationable offenses. • Effective date: July 1, 2021.

6) Law Enforcement Complaints, pp. 49, 58, 66, 68, 93: No sworn statements made against officers anymore. Also removes the sharing of the name of the person, rank, or unit in charge of an investigation. (Apparently, officers must’ve known who was handling the complaint against them previously). Prevent police officers from retaliating against a person for filing complaints. Complaints against police will stay on their record permanently. Must report all officers that resign due to any felony or sex offense incident rather than just Class 2 or greater felony offense. Authorizes state attorneys to access termination of those officers information or resignation data. • Effective date: July 1, 2022

8) Uniform Crime Reporting, p. 89: • Updates State Police crime reporting to monthly rather than yearly (annually). Mandates the state participate in the FBI’s National Use of Force Database. Requires law enforcement to report to the State Police any use of force incident or any incident where police are dispatched to respond to mental health crisis or incident. Effective July 1, 2021. 9) Revocation of Driver’s License due to Unpaid Fines, pp. 189: • Secretary of State will re-issue licenses for reverse suspension, cancellation, or renewal due to unpaid fines or penalties for traffic violations, automatic traffic enforcement system violations, or abandoned vehicle fees. Cannot suspend license due to speed cameras, red-light cameras, or other automated enforcement systems. • Effective date: July 1, 2021
10) Resisting Arrest, p. 273: • Requires this offense to accompany another criminal offense that led to the resisting charge. What this means is that police cannot just arrest you for resisting arrest.
• Resisting arrest charges per year: 10,000
• Resisting arrest convictions per year: 300
• 20% of arrests for resisting arrest did not have another charge at the time of the arrest.
• SPAC is unable to determine if these arrests would change outcomes as a result of the reform.

11) Peace Officer Use of Force, p. 283, 288: • Requires that the reasonableness of a peace officer’s use of force must be assessed based on the totality of the circumstances, including that the officer reasonably believes the person cannot be apprehended later, the person is likely to cause great bodily harm to another, and that the prior forcible felony was just committed.
• The officer must assess whether the imminent danger is present,
• Can us force if a person is trying to escape, based on a totality of circumstances, or if it is necessary to prevent death or great bodily harm.
• Allows deadly force only when necessary to prevent death or great bodily harm.
• Applies to anyone or any agent authorized by law enforcement offices.
